What Is Cyberstalking?
Cyberstalking is an activity in which a person or abuser or stalker stalks or harass another person or victim by misusing the internet or electronic media. In cyberstalking a stalker may contact a person either by an email, social media, messaging apps or other online media. To harass a person a stalker may post messages, pictures or information online about a person. Some may also track location or online activities.
Kinds Of Cyberstalking
Women in India whether she is a college student, working professional or housewife get stalked on a regular basis. Stalking itself is a criminal offence either physical or electronic and is punishable with one to three years of jail.
Catfishing - In Catfishing, Stalkers create a fake profile on social media to approach victims. Sometimes they copy the existing user's profile with photos to look it like a real one.
Hijacking webcam - Computer's webcam hijacking is one of the most disgusting methods of cyberstalking to invade the victim's privacy. Stalkers push malware-infected files into the victim's computer which gives them access to the webcam.
2. VOYERISM- Under the IT Act, voyeurism is a crime, irrespective of gender. Section 66E of this Act provides for punishment in cases of violation of privacy. It states that any act by a person who, knowingly or unknowingly, without consent, takes a photograph of the private areas of a person, or sends such a photograph to someone else or publishes such a photograph, under circumstances which violate the person’s privacy, will be considered a crime.
‘Circumstances violating privacy’ under the IT Act constitute those circumstances in which a person is disrobing without being captured or has a reasonable expectation that their private areas will not be seen by the public.
3.Photo morphing in this unauthorised user with fake identity downloads the pictures of an individuals then uploads them after editing. In simple words morphing means to an image by using computer animation; to change in this way that whose pictures is morphed is hardly able to recognise it.
Cyber ****ography- Cyber ****ography means the publishing, distributing or designing ****ography by using cyberspace.
1.Viewing Cyber ****ography is legal in India. Merely downloading and viewing such content does not amount to an offence.
2. Publication of ****ographic content online is illegal.
3. Storing Cyber ****ographic content is not an offence.
4. Transmitting cyber ****ography via instant messaging, emails or any other mode of digital transmission is an offence.
Child ****ography- Section 67B of the IT Act, 2000 makes it publishing, transmitting, viewing or downloading child ****ography illegal.
5. Cyber Defamation- The term ‘Cyber Defamation’ basically means publishing of false statement about an individual in cyberspace that can injure or demean the reputation of that individual. In India, defamation can be contemplated as both civil and criminal offence, and thus legal remedies are provided to the victims by the Indian judiciary system.
Cyber defamation involves defaming a person through a new and far more effective method such as the use of modern Electronic devices. It refers to the publishing of defamatory material against any person in cyberspace or with the help of computers or the Internet.
1. The very first step to file a cyber crime complaint is to register a written complaint with the cyber crime cell of the city are currently in.
cyber crime complaint can be registered with any of the cyber cells in India, irrespective of the place where it was originally committed.
Register a Cyber Crime FIR: If you do not have access to any of the cyber cells in India, you can file a First Information Report (FIR) at the local police station.
Certain cyber crime offenses come under the Indian Penal Code. You can register a cyber crime FIR at the nearest local police station to report them.
It is mandatory under Section 154, Code of Criminal Procedure, for every police officer to record the information/complaint of an offense, irrespective of the jurisdiction in which the crime was committed.
